The following Terms and Conditions shall apply to your use of the Website owned and operated by Jagtap Horticulture Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at Jagtap Horticulture Private Limited Gete No .147 Village Ardav, Taluka Marval, District Pune-410406  (hereinafter referred to as “We” / “us” / “MyFlorist”) through its website (www.myflorist.shop) (hereinafter referred to as “Website”) under the brand name ‘MyFlorist’, that inter alia allows its users to browse, select and order a gifting item for their loved ones or relative or friend or family member or to the recipient as per the request of user.

Your registration data and other information collected through the use of this Website is subject to the Privacy Policy. You acknowledge that through your use of this Website, you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer, as necessary and permitted under the applicable laws. Product

The products/services provided on this site are without warranties of any kind either expressed or implied and MyFlorist disclaims all or any of them fully. MyFlorist does not warrant that the products/services offered will be error-free, or that the defects will be corrected, or that this site or the server that makes it available are or will be free of viruses or other harmful components. Purchase of a product depends on availability of stock. Flower arrangements are handmade and as such, will differ from the picture displayed on the website. Any warranties or After Sale Services if any offered by the Manufacturers/Vendors on any product shall be serviced directly by such Manufacturer/Vendor and MyFlorist shall not be under any obligation to ensure compliance or handle complaints.

The product specifications (weight, size, color etc.) mentioned with the product photos are only approximate. Most products here are handmade items. There may, hence, be a variation in the pictures and the respective products. In rare cases, we may deliver a similar / alternate product for reasons or exigencies beyond our control like regional unavailability, keeping you always informed. 

In the event a product or service is listed at an incorrect price or with incorrect information due to typographical error or error in pricing, we have the right, post the acceptance of any order, to decline or cancel any such order, whether or not the order has been confirmed and/or you have been charged for such product or service. If you have already been charged for the order, please write to us at sales@myflorist.com and we will offer a refund.

Delivery Charges

We do not control delivery charges, or extra charges of taxes/octroi in certain areas. Our delivery partner charges are added before final payment page and are paid to them directly to schedule deliveries.

Since flowers and plants are perishable items, and gifting can be time sensitive, the delivery would be attempted only once. If the delivery is not executed during that attempt due to incorrect or insufficient address, recipient not at home, address found locked or refusal to accept, you will still be charged for the order. No refunds would be entertained for such items.

Acknowledgment and Changes

We are not liable for any loss of data, loss of profits or any damages whatsoever including, without limiting, any indirect, special, incidental, consequential or other damages that result from the use of or inability to use the products/services offered on the site. Notwithstanding the foregoing, in no event shall we be liable for any or all damages, losses, and causes of action (including but not limited to, negligence) or otherwise exceeding the amount paid to us for that specific service/product.

We reserve the right to make changes to the products, services, and other content on this website. Prices and availability are subject to change without prior notice.

You are presumed to have read all the terms and conditions herein and FAQ and deemed to have agreed, understood and accepted unconditionally all the terms, conditions, procedures and risks of using the services and cannot at any time claim ignorance of any or all of them. In event of any disputes Let’s endeavour to settle the dispute amicably. If we cannot do so, the dispute shall be referred to sole Arbitrator, governed by the Arbitration and Conciliation Act, 1996. All the disputes will subject to the Judiciary of Pune, Maharashtra.
